General Terms and Conditions for the rental of seminar and conference rooms at Die Kabine by Birger Siemering
1. Scope
These General Terms and Conditions apply exclusively to the provision of conference rooms for events at the conference centre of Birger Siemering (hereinafter "Die Kabine") to the customers of Birger Siemering (hereinafter "Customer"), as well as to all related services.
Conflicting or differing terms, including any contained in the Customer's general terms and conditions, do not apply unless expressly recognised in writing by Die Kabine.
The provisions of Die Kabine's reservation confirmation take precedence.
2. Conclusion of the rental contract
The Customer's booking enquiry to Die Kabine constitutes an offer to conclude a rental contract. Die Kabine accepts the offer through a written reservation confirmation, at which point the rental contract comes into effect.
All offers from Die Kabine are non-binding.
If the Customer is not also the organiser and user of the rooms, this constitutes a sub-let, which is only permitted with prior written consent from Die Kabine.
3. Subject and duration of the rental
The conference room listed in the reservation confirmation, together with the equipment specified, is provided to the Customer in proper condition for the duration of the rental period at the agreed price.
If the Customer does not raise any objections upon taking over the rented property, it is deemed to have been received free of defects.
At the end of the rental period, the Customer is required to vacate the rented property and return all associated facilities to their original condition.
4. Use of the rented property
Set-up, holding and tear-down of the Customer's event must be coordinated with Die Kabine. The Customer must comply with all applicable legal regulations.
The Customer is entitled to use the rented property Monday to Friday between 8:00 and 18:00. Use outside these hours requires a written agreement.
Smoking is not permitted anywhere in the building.
5. Rent
The rent shown in the reservation confirmation, plus VAT, applies. All invoices are payable in full no later than fourteen days after receipt.
6. Catering, facilitation materials and conference technology
Die Kabine provides facilitation materials and conference technology (projector, whiteboard, flipchart, pin boards) to the Customer. The cost of the conference technology is included in the rent.
Guests may use a guest Wi-Fi network. As access is free of charge, there is no claim to an interruption-free connection.
7. Customer liability
The Customer is liable in accordance with statutory provisions for property and personal damage caused during the rental period. Die Kabine accepts no liability for items brought into the property.
8. Liability of Die Kabine
Die Kabine is liable for ordinary negligence in the event of injury to life, body or health, and for breach of essential contractual obligations. Otherwise, Die Kabine is liable only for intent and gross negligence.
9. Access to the rented property
Die Kabine and third parties commissioned by Die Kabine must be granted access to the rented property at any time during the agreed rental period.
10. Withdrawal and termination
Die Kabine is entitled to withdraw from the contract or terminate it without notice and without compensation if the Customer breaches these provisions or if a disturbance of public safety is to be expected.
The Customer is entitled to withdraw before the start of the rental period. Cancellation fees: more than 4 weeks before: none; from 4 weeks: 50%; from 1 week: 75%; from 2 days: 100%.
11. Data protection
Die Kabine attaches great importance to the protection and security of personal data and processes personal data in accordance with the General Data Protection Regulation (GDPR).
12. Final provisions
These General Terms and Conditions form part of the rental contract. Side agreements, amendments and supplements must be made in writing. The place of performance and jurisdiction is Hannover.
